In short: SAIKER watches your trips and tells you what it finds. Your operator and your pilots in command make every operational decision. You own your data. We use it only to run SAIKER for you.
1These terms
These terms govern your use of SAIKER, the agentic flight operations system, and of this website. SAIKER is provided by Awaire Technologies LLC (“SAIKER”, “we”, “us”). “Customer” or “you” means the operator or company that uses SAIKER, and the people it invites.
If you accept these terms for a company, you confirm that you may bind it. If your company has signed an order form or other written agreement with us, that agreement takes priority where it differs from these terms.
2What SAIKER does
SAIKER reads your trips from your scheduling system and checks them against official and operational data: weather, NOTAMs and flight restrictions, FAA flight data, airport information, crew duty and your own company procedures. It shows findings, explains them and prepares drafts for your team.
SAIKER is decision support. It does not release, approve, dispatch or cancel flights. It does not give instructions on how to fly an aircraft. Features may be in development or offered as a trial, and we will say so when they are.
3SAIKER informs; the operator and pilot in command decide
The pilot in command is directly responsible for, and is the final authority as to, the operation of the aircraft (14 CFR 91.3). Operational control stays with the operator under its certificate, management specifications or operations specifications. Nothing SAIKER shows changes who holds that authority.
- Treat every SAIKER finding, score, summary and draft as information to check, not as a decision.
- SAIKER is not a substitute for official sources or for your required documents. These include official weather and NOTAM briefings, charts, your operations specifications, your general operations manual, your safety management system manual and any risk assessment form the FAA has accepted for your operation.
- SAIKER can miss something, flag something late, or flag something that does not matter. Keep your own procedures for watching trips, and do not rely on SAIKER as your only means of knowing about a change.
- Risk scores and checklists reflect the rules and weights your company sets. Your company remains responsible for its risk assessment, its safety management system and its records.
4Data from other sources
SAIKER uses data from government and commercial sources. They include the FAA (System Wide Information Management, NOTAMs, flight restrictions and airport data), the National Weather Service and Aviation Weather Center, RainViewer radar, map tiles from CARTO and OpenStreetMap contributors, and, where turned on, FlightAware.
We do not control these sources. Their data can be late, incomplete, wrong or unavailable, and we provide it as received. We do not guarantee that any source has provided data that is accurate, complete or current. Some sources have their own terms of use, which apply to that data.
SAIKER shows flight data only for aircraft and flights your organization operates. Aircraft on the FAA's Limiting Aircraft Data Displayed program, and flights marked as privacy protected, are not shown to anyone other than their operator.
5AI features
Some features use artificial intelligence: Ask SAIKER, written summaries, drafts of messages, and setup from documents you upload. AI output can be wrong or incomplete even when it reads well. Where SAIKER checks AI output against its own data, it marks what it could not confirm. Read and check AI output before you act on it or send it.
AI does not decide findings or severities, which come from explicit rules. Drafts are not sent to anyone unless a person on your team chooses to send them. Setup proposals made from your documents take effect only when someone with the right role approves them.
6Accounts and security
Accounts are created by invitation. Every account must use an authenticator app as a second factor. Your administrators decide who is invited and what role each person has, and are responsible for removing access when someone leaves.
Keep sign-in details private. Tell us at hello@saikeraero.com as soon as you suspect anyone has used an account without permission. You are responsible for activity under your organization's accounts.
Pilots may receive a link to review and sign a flight risk assessment without an account. Your organization decides who receives these links.
7Your data
You own the data your organization puts into SAIKER or connects to it: trips, aircraft, crew details, documents, risk assessments, safety records and notes (“Customer Data”). You give us a limited right to use Customer Data only to provide, secure and support SAIKER for you, and as our Privacy Policy describes. We process personal information in Customer Data on your behalf and under your instructions.
You are responsible for having the right to share Customer Data with us, including any notice your crew and staff need about how their information is used. SAIKER reads your scheduling system; it does not write to it.
We do not sell Customer Data. We do not use Customer Data to train AI models, and our AI provider does not use it to train its models.
8Acceptable use
You agree not to:
- use SAIKER to track aircraft your organization does not operate or is not entitled to watch;
- try to get around privacy protections for aircraft, including the FAA's Limiting Aircraft Data Displayed program;
- copy, resell or redistribute SAIKER or the data it shows, beyond your own operation;
- reverse engineer SAIKER, probe or test its security without our written permission, or overload it;
- upload anything unlawful, or anything you have no right to share;
- give access to anyone outside your organization other than as SAIKER allows, such as pilot risk assessment links.
9Our property and feedback
We own SAIKER, its software, its rules and its design. These terms give you a right to use SAIKER while your subscription or trial lasts, and nothing more. If you send us suggestions, we may use them without obligation to you.
10Fees
Fees, billing periods and any trial are set out in your order form. Fees exclude taxes, which you pay except for taxes on our income. If an invoice is unpaid 30 days after its due date, we may suspend access after giving you at least 10 days' written notice.
11Availability and changes
We work to keep SAIKER available, but we do not promise that it will be uninterrupted or free of errors. Unless your order form says otherwise, there is no service level agreement and no service credit.
We may change SAIKER over time. If a change removes a feature you rely on, we will tell you in advance where we reasonably can.
12Confidentiality
Each side will keep the other's confidential information private and use it only for the purposes of these terms. This does not cover information that is public, already known to the receiving side, or received from someone else without a duty of confidence. Either side may disclose information when the law requires it, after notifying the other side where the law allows.
13Disclaimers
Except as your order form states, SAIKER is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, accuracy and non-infringement. We do not warrant that SAIKER will detect every condition that affects a trip.
14Limitation of liability
To the extent the law allows, neither side is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, however caused.
Each side's total liability arising from these terms is limited to the fees you paid us for SAIKER in the 12 months before the event giving rise to the claim. If you use SAIKER free of charge, our total liability is limited to US$100.
These limits do not apply to your payment obligations, to either side's indemnity obligations, or to liability that the law does not allow to be limited.
15Indemnities
We will defend you against a third-party claim that SAIKER infringes that party's intellectual property, and pay the resulting damages a court awards or that we agree to in settlement. This does not apply to claims caused by Customer Data, by changes not made by us, or by combining SAIKER with something we did not provide.
You will defend us against a third-party claim arising from Customer Data, from your flight operations, or from your use of SAIKER in breach of these terms, and pay the resulting damages a court awards or that you agree to in settlement.
The side seeking protection must tell the other promptly, let it control the defence, and give reasonable help.
16Term, ending and your data
These terms last while you use SAIKER. Either side may end them as your order form allows, or at once by written notice if the other side materially breaches them and does not fix the breach within 30 days.
When your subscription ends, you may export your Customer Data for 30 days. We then delete it from SAIKER within a further 30 days, and from backups as they expire on their normal cycle, unless the law requires us to keep it. We will confirm deletion in writing on request.
17Export control and sanctions
You will comply with United States export control and sanctions laws when you use SAIKER. You will not use SAIKER in, or give access to anyone in, a country or region under comprehensive US sanctions, or to anyone on a US government restricted-party list.
18Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. The state and federal courts located in California have exclusive jurisdiction over any dispute arising from these terms, and each side consents to them.
19General
We may update these terms. We will post the new version here with a new effective date and, for a material change, tell your administrators by email at least 30 days before it applies to an active subscription.
Neither side may transfer these terms without the other's consent, except to a successor in a merger, reorganization or sale of the business. Neither side is liable for delay caused by events beyond its reasonable control. If a part of these terms cannot be enforced, the rest still applies. A failure to enforce a term is not a waiver of it.
